These Terms of Service ("Terms") govern your access to and use of Freelanced Nepal, a digital freelance marketplace operated by Black Snow Nepal Pvt. Ltd. ("Company", "we", "us", or "our"), a company registered under the laws of Nepal.
By creating an account, accessing, or using the platform in any way, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the platform.
We may update these Terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the updated Terms. We will notify registered users of material changes by email at least 14 days before they take effect.

If you are using the platform on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.
Freelanced Nepal is a marketplace platform that facilitates connections between Employers (individuals or businesses seeking freelance work) and Freelancers (independent professionals offering services). We are not a party to any contract formed between Employers and Freelancers, and we are not an employer of any Freelancer.
We provide the infrastructure, escrow service, messaging system, and dispute resolution mechanism. The Company assumes no responsibility for the quality, safety, legality, or delivery of any services exchanged through the platform.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately atsupport@freelancednepal.comif you suspect any unauthorised use.
Each person may hold only one account. Creating multiple accounts to circumvent suspensions, bans, or platform rules is prohibited and will result in permanent removal from the platform.
Freelancer accounts require manual verification before proposals can be submitted. We reserve the right to approve or reject Freelancer applications at our sole discretion.
All payments on Freelanced Nepal are processed through an escrow system to protect both parties:
Payments are accepted in Nepalese Rupees (NPR) via licensed local payment gateways. International bank transfers (SWIFT) are accepted with prior arrangement. All amounts displayed on the platform are in NPR unless otherwise stated.
Platform wallet balances are held by Black Snow Nepal Pvt. Ltd. and are not insured or interest-bearing. Wallet funds can be used for future platform transactions or withdrawn via bank transfer per our Refund Policy.
Upon full payment and release of escrow funds, the Employer receives full ownership of all custom work product created by the Freelancer for that specific project, unless the parties have agreed otherwise in writing within their project scope.
Freelancers retain the right to display completed work in their portfolio unless the Employer has requested confidentiality as part of the project agreement.
Pre-existing intellectual property, tools, frameworks, and methodologies used by the Freelancer remain the property of the Freelancer. Only the bespoke deliverable is transferred.

If an Employer and Freelancer cannot resolve a disagreement directly, either party may raise a formal dispute through the platform's dispute interface within 7 days of the delivery date.

We reserve the right to suspend or permanently terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to other users or the platform, at our sole discretion and without prior notice where circumstances require immediate action.
Upon termination, any pending escrow funds will be handled per our Refund Policy. Wallet balances belonging to non-violating users will be made available for withdrawal within 30 business days.
These Terms are governed by and construed in accordance with the laws of Nepal, including the Contract Act, 2056 (2000) and the Company Act, 2063 (2006). Any disputes arising from or related to these Terms shall first be subject to good-faith negotiation, then mediation, and finally — if unresolved — to the jurisdiction of the courts of Kathmandu, Nepal.
International users: If you are accessing the platform from the European Economic Area (EEA) or United Kingdom, we acknowledge your rights under the General Data Protection Regulation (GDPR) and UK GDPR. These rights are described in ourPrivacy Policy. However, the governing law and jurisdiction for contractual disputes remains Nepal.
